Tell the Time Co. offers a professional and flexible consignment service for owners looking to sell their luxury watches.
These terms provide a general overview of our consignment process. The specific watch details, agreed owner return and custody arrangements will be confirmed separately in writing before the watch is listed.
1. Watch Assessment
We will assess the watch and provide guidance on its current market value based on factors including its brand, model, condition, age, accessories and current demand.
The owner will tell us the minimum amount they would like to receive from the sale. This amount must be agreed to by both parties before the watch is advertised.
Market estimates are provided as guidance only. We cannot guarantee a sale price or how quickly a watch will sell.
2. Our Fee
There are no upfront consignment fees unless otherwise agreed in writing.
The owner will receive the agreed net amount if the watch is sold. Tell the Time Co. may advertise and sell the watch above this amount, with the difference between the final sale price and the agreed owner return retained by Tell the Time Co. as its fee.
Any change to the owner’s agreed return must be approved by the owner before the sale is completed.
3. Photography and Marketing
Tell the Time Co. may professionally photograph, film, describe and advertise the watch through our website, showroom, social media accounts and selected third-party sales platforms.
We will represent the watch as accurately as reasonably possible based on its condition and the information supplied by the owner.
The owner’s personal information will not ordinarily be included in public advertisements.
4. Watch Custody
The watch may either:
- Remain securely stored with Tell the Time Co.; or
- Remain with the owner until a suitable buyer is found.
The agreed arrangement will be confirmed before the watch is listed.
Where the owner keeps possession of the watch, they must keep it in substantially the same condition and make it available within a reasonable period when required for inspection, collection or insured shipping.
Where Tell the Time Co. holds the watch, it will be stored securely and handled with reasonable care. Any responsibility for physical loss or damage while the watch is in our possession will be determined in accordance with the agreed consignment arrangement and any applicable insurance coverage.
5. Ownership and Condition
The owner confirms that:
- They are the legal owner of the watch and have the right to sell it;
- The watch is not stolen, financed, pledged or subject to another person’s claim;
- All information supplied about the watch is accurate;
- All known faults, damage, modifications, aftermarket parts and servicing history have been disclosed; and
- Any box, papers, links, straps or accessories supplied with the watch are accurately described.
Tell the Time Co. may decline or withdraw a watch from sale if concerns arise regarding its authenticity, ownership, condition or supporting information.
6. Offers and Sale Approval
Tell the Time Co. may communicate with potential buyers and negotiate within the agreed pricing arrangement.
We will not complete a sale below the owner’s agreed net return without first receiving the owner’s approval.
Once the owner has accepted an offer or a sale has been confirmed with a buyer, the owner must not withdraw or sell the watch elsewhere.
7. Payment to the Owner
The owner will be paid the agreed net return after:
- Full cleared payment has been received from the buyer;
- The watch has been delivered or collected;
- Any required transaction checks have been completed; and
- There is no known payment dispute, chargeback or other issue preventing settlement.
Payment will ordinarily be made by bank transfer to an account in the owner’s verified name.
8. Withdrawal of an Unsold Watch
The owner may withdraw an unsold watch at any time before accepting an offer or before a sale is confirmed.
Where Tell the Time Co. holds the watch, the owner may arrange collection from our Sydney showroom. If shipping is requested, the owner may be responsible for the cost of secure and insured delivery unless otherwise agreed.
Any approved servicing, authentication, delivery or other third-party costs must be paid before the watch is returned.
9. Repairs and Additional Costs
Tell the Time Co. will not arrange paid servicing, polishing, replacement parts or other material work without the owner’s approval.
Any approved costs and responsibility for those costs will be confirmed in writing before the work is carried out.
10. Governing Law
These consignment terms are governed by the laws of New South Wales, Australia.
Nothing in these terms excludes any rights or obligations that cannot lawfully be excluded.
